1Definition and introduction

1.1.1   The following words and terms should be interpreted as follows, unless, the context clearly implies otherwise.

User Account

A personal account opened by an individual and maintained by us as to allow this person to play the on-line poker games.

Software

The software licensed by us including all programs and databases and any other derived content, requiring download, accessible or otherwise used by you through the website and allowing you to participate in the online poker games.

Login and Password

The Login and password that you chose upon registering with the online poker games.

You

The user of the service and/or the Poker770 software downloaded from its Internet Site.

1.2.1  This User Contract (hereafter referred to as ' the contract '), once agreed to, is effective immediately and shall be the official and unique source of reference for any complication related to the use of our Internet site, service and/or software (hereafter referred to as 'the software'). This contract, which can be modified regularly, will govern your use of http://www.Poker770.com/, Internet site or any other equivalent Internet address or substitute, and your use of our software.

1.2.2  The site authorizes you to download and/or use our software with the purpose of playing at the poker games on the Internet (hereafter referred to as 'the service'). Poker770 reserves the right, at its sole discretion, to suspend, modify, end, and/or add elements to its service.

1.2.3   You can use the software to forward to others the information concerning your bets related to our online poker games. We will not accept any bet between you and our internet site.

1.2.4   We use this internet site in such a way as to enable the users to make bets between themselves. By means of this service we receive:

a. A commission (known under the name of 'rake') that is calculated in conformity with our internal rules and regulations; or

b. A percentage of amounts of 'buy-in' for the tournaments.

1.2.5   None of our executives, our affiliated companies, or even any of our providers or sellers, nor their relatives (in this clause, the term 'relatives' means spouse, partner, parents, children or siblings of the people mentioned above) are authorized to use the service directly or indirectly. If this clause is breached, Poker770 reserves the right to close said account immediately.

1.2.6   In the event of misuse and/or the opening of excessive accounts (one per player), abuse of promotions and/or of any offers from Poker770, Poker770 reserves the right to close or block the accounts of the client in question until the matter between Poker770 and the client is entirely resolved.

1.2.7   In the event of any kind of software interruption due to any type of problem, Poker 770 reserves the exclusive and absolute right of requesting a screenshot that would allow to state at exactly which moment of the game the interruption of the service offered have affected the game of the player.

1.2.8   Poker770 reserves the right to modify (at any time) the limits of our games and apply limits reasonably different to players according to their game history and without any justification.

2Purpose of the contract

2.1   The object of this contract is to govern the legal relations between Poker770 and the software user so that he/she is informed of our conditions and can install our software on his/her computer, with the purpose of playing poker games on our Internet site.

3Legal clauses

3.1   You can only use our online poker service if you have attained the age of legal maturity in your country of residence. In case of non-conformity, we will have the right to bring suit against you at our sole discretion.

3.2   Poker770 reserves the right to request proof of age and identity of the user, at any time.

3.3   You are entirely responsible of informing yourself with respect to the effective laws in your jurisdiction so as to be certain of the use of the Internet.

3.4   Each player must confirm that they have the legal age (21 years old in the United-States at the time of the tournament) in order to benefit from the package. No package will be refunded if the palayers is under 21.

3.5   Any breach concerning passports or visas will lead to the cancellation of the package without any refund, any financial or any other compensation.

4Your declarations and responsibilities

Intellectual property
4.1 By the present contract, we grant you a personal, non exclusive and non transferable right of using our software, allowing the use of our online poker games according to this section's arrangements.

Data accuracy
4.1.1 You acknowledge that all the information contained in the registration form that you sent to Poker770 is true, accurate and complete, and corresponds completely to the name(s) written on the credit card(s) used for any deposit and/or withdraw. We reserve the right to immediately terminate your user contract if the information you declared is proven to be false, inaccurate, fallacious, fraudulent and/or incomplete.

Single account
4.1.2The use of our service and/or our software is a right that is bestowed upon you with a personal and not a commercial purpose. A third party can use your account, your password or your username to access our software or service. Poker770 will not accept any complaints relating to activity on your account by a third party.

Contract's acceptance
4.1.3 By downloading our software, you acknowledge to have thoroughly understood all methods, rules and procedures of our Internet site and our online poker games. We hereby grant you the right, following the acceptance of this contract, to use our Internet site, our service and the software.

Responsibilities in case of loss
4.1.4 You are perfectly conscious that by playing our online poker games, you are under the risk of losing money. It is your sole responsibility to assume all your payments towards Poker770 and, in the case of conflict, you will be incapable of refusing any payments due to Poker770 or to revert any payments made and that you would as well compensate Poker770 with a sufficient amount, should Poker770 suffer any loss with relation to your payments.

Brand image
4.1.5 You shall not commit any act or adopt any kind of behaviour that could damage Poker 770's reputation, or else the Poker770 brand image, its holding and its subsidiaries and you acknowledge that you will use our service and/or our software solely at your own discretion assuming the risks and obligations related to it.

Frauds
4.1.6 You certify that the funds used by the User to play our games are not from illegal sources, and that in no way will you use our service and/or the software with the purpose of any illicit or fraudulent activity (which includes but is not limited to money laundering).

Transactions
4.1.7 Poker770 reserves the right to cancel or block the account(s) of its clients, at any time in the case of fraudulent transaction. Poker770 will be in no case linked, assimilated and/or held responsible for any fraudulent use of credit cards.

Artificial Intelligence
4.1.8 You certify that you will not violate or attempt to violate or misconstrue in any way Poker770's security measures or to use an artificial intelligence. Should this be the case, Poker770 reserves the right to immediately cancel or block your client account, not to reimburse you the amount credited and to forbid your access to all other Internet sites, services or software that our corporation or its subsidiaries could offer.

Collusion
4.1.9 Each player caught using or attempting to use our online poker games in a collusive manner, either on his own or with several players,will be permanently forbidden access to the service and/or software that our corporation or its subsidiaries could offer. The account of players suspected of collusion will immediately be cancelled and Poker770 reserves the right to not refund the amount credited to those accounts. Poker770 reserves the right, at its discretion, to take legal action against players involved in acts of collusion, relating to the use of our online poker games. Poker770, for its part, has developed and used sophisticated technology designed for research and the identification of users behaving in a collusive way. All measures regarding one or several players suspected of collusion, cheating or any other form of fraud will be solely at the discretion of Poker770.

«Chip-Dumping»
4.1.10 'Chip- Dumping' occurs when a player deliberately loses his hand with the purpose of transferring his chips to another player participating at the same table. Any player practising 'Chip-Dumping' will be permanently forbidden any use of service and/or software of our corporation or its subsidiaries. Poker770 reserves the right, at it sole discretion, to bring any legal action against the players. The account of players involved in, suspected of, or even having attempted «Chip- Dumping» while using our online poker games, will immediately be cancelled and Poker770 reserves the right to not refund the amount credited to those accounts. Poker770 reserves the right, at its discretion, to take legal action against players who have taken part in or suspected of taking part in acts of «Chip-Dumping». All measures regarding one or several players suspected of «Chip- Dumping», cheating or any other form of fraud will be solely at the discretion of Poker770.

Table Blocking / Hogging
4.1.11In order to guarantee the optimum gaming conditions at Poker770 tables, any player who intentionally refuses to play against any particular player (« Table Blocking ») and/or intentionally play against weaker players (« Hogging ») will face disciplinary measures. All measures taken against one or more players suspected of «Table Blocking» and/or « Hogging », cheating or any other forms of fraud, will solely be at Poker770's discretion.

Proof request
4.1.12 You acknowledge that Poker 770 reserves the right to request proof of deposit to a client for all alternative payments, at any moment, (i.e.: Click2Pay, MoneyBookers, Neteller, invoices or others). Poker770 reserves the right to request its clients' bank account numbers at any time.

Interests
4.1.13 You agree with the fact that any amounts deposited in your account can in no way generate interests.

Taxes
4.1.14 You are solely responsible for the filing, payment, and accounting of taxes and/or any other kind of taxes or exceptional taxes that you may be accountable for to any pertinent government in the event that you benefit from any gains at Poker770.

Access provider
4.1.15 You are solely responsible for all telecommunication network, Internet Service and for all other authorization or permit required in relation to the use of our service and/or the software. In the case of dysfunction coming from the Internet provider, Poker770 will be in no way held responsible.

5Our declarations and responsibilities

5.1 Mandarin Gaming NV, a commercial international corporation, owns all permits and licenses required to run an online poker site. Poker770 is entirely governed by the laws of Curaçao, the Dutch Antilles, and has an absolute right to offer, by means of a software, online poker games under the name of Poker770.

Corporate name
5.2 The corporation, Chicoutimi Management Limited, owns and entirely operates the poker http://www.Poker770.com/ ((hereafter reffered to as ' Poker770'). The corporation Chicoutimi Management Limited is situated at the following address : Diagorou4, Kermia Building, Flat/Office 103, P.C. 1097, Nicosia, Cyprus.Chicoutimi Management Limited is a subsidiary of Mandarin Gaming NV PO Box 4920, Curaçao, Dutch Antilles. The customers of Poker770 Can identify each transaction done on our website since our name is mentioned on the bank statement under on the following three Mandarin 770, Aquapay London or Lafayette.

Winnings refund
5.3 Poker 770 is committed to paying all gains obtained by the user according to the conditions established in this contract. You acknowledge that the payments from our side can be verified and administered by third parties' enterprises' electronic payment processors and/or by independent financial institutions.

Password loss
5.4Poker770 in in no way responsible if the user forgets, misplaces, or loses his/her password, except as a result of an error on the part of Poker 770. Poker770 is not responsible to store passwords and logins of the user

Secure servers
5.5 Poker770 uses the latest private/public encryption methods to better guard the password and logins used by the user in order to secure access to the service and/or Software vis-à-vis of third parties during Internet broadcast

Games' fairplay
5.6 Poker770 guarantees that the use of the software of poker games games on the Internet offers the user complete randomness and equitable chances thanks to the Software RNG (RNG: Random Number Generator) in all randomly generated competitions.

Losses and transactions
5.7 If it occurs that the user owes any money to Poker770, the corporation reserves the right to deduct a positive balance from the user's account equivalent to that which is owed by the user;

5.8 Poker 770 reserves the right to limit or refuse any bet, wager, or any other type of gamble made by the user or through his account. Should such situation occur, Poker770 reserves the right not to provide any explanation whatsoever justifying this decision.

Disrespect of contract 
5.9  Poker770 is in no way expected to investigate or to give suit to a complaint made by a user against another user for any reason, including but not limited to the conditions in this contract. Poker770 reserves the right to rescind the user's account suspected of illicit actions or wanting to violate the conditions of this contract. Poker770 reserves the right to bring suit against a user whose customer account has been closed on the base of terms listed in this clause.

Proper use of software
5.10 Poker770 is under no obligation to verify if all users properly use the service and/or the software according to the updated rules of this contract.

6Bonus

6.1 Poker770 has only one rule for its bonuses : 'You can withdraw only what you have won in addition to your bonus'.

6.2 All bonuses, promotions, special offers, and/or bonuses offered on the user account should be used according to the established rules. Poker770 reserves the right to rescind any bonus or special offer or promotion at any time.

6.3 Please note that real money accumulated in your player account is available for poker as well as for the ‘side games’ offered by our service. We would like to inform you the ‘side games’ bonus is only usable for the casino ‘side games’ and could only be used in the game when the money accumulated in your player account has completely run out. To convert a ‘side games’ bonus into real money, you have to bet a minimum of 20 times the amount of the bonus.

6.4 Bets placed on Blackjack and Roulette games do not count when calculating total bets (playthrough).

6.5 Poker770 offers many free bonuses, such as welcome bonuses, fidelity bonuses, account reactivation bonuses and many more besides, which allow you to play without making a deposit beforehand. However Poker770 would like to notify you that you can only withdraw the amounts won from this bonus after you have made a minimum deposit of €/$/£20.

6.6 Winnings can not be withdrawn until the required number of accumulated bets (playthrough) has been reached.

6.7 Conditions for the awarding of the free bonuses can vary depending on the country where the player lives.

7Bonus seeker

Definition
7.1 A Bonus Seeker is, according to Poker770, a client who abuses bonus offers during the first deposit or regular deposit promotions and who, in addition, withdraws everything that was deposited playing only with the chips offered by Poker770 and this, in a repetitive manner.

A user can use his reward bonuses only if his last transaction in keeping with financial services is a deposit. From the moment when a user withdraws the money from his account, Poker 770 reserves the right to block the use of the bonus and other reward bonuses. Poker770 wishes to remind to all users that recredits are not part of deposits.

Certificate without a deposit
7.3 The use of the certificate without a deposit, which constitutes no gain, does not label a user as a 'Bonus Seeker'.

7.4 From the moment when Poker770 declares a user a 'Bonus Seeker', the user will no longer benefit from any promotional bonus during a defined period and at the discretion of Poker770.

7.5 Poker770 reserves the right to label a user as a 'Bonus Seeker' in the following instances:

7.5.1 If the user plays €/$/£200 or more from a bonus coupon without making any deposits to his account; or

7.5.2 If the user plays for €/$/£200 or more from a bonus coupon and the total amount of his bonus is superior to the amount of his deposit; or

7.5.3 If the user plays with more than one bonus in a 24 hour period.

8Transactions

Solvability
8.1  Poker770 reserves the right to verify the financial solvency of any of its users, through the information furnished during registration and through third parties.

Transparence
8.2   The payments from our part relating to the use of our service and/or software can be verified and administered by electronic payment processors of third parties' companies and/or by independent financial institutions. By accepting this contract, you confirm to have been informed about these electronic methods of payment.

8.3 The prices of Poker770 shop items are subject to modification at any time and may also incur delivery charges (in addition to stated price).

9Withdrawals

9.1   To withdraw money from his client account, the user must withdraw a minimum amount of €/$/£20 using MoneyBookers, Neteller or Click2Pay and €/$/£20 and any other superior amount using wire transfer or his credit card. For any withdrawal below, the user must contact Poker770 support team.

9.2   To withdraw money from his account, the player must have made a minimum deposit of €/$/£20.

9.3   All payments shall take place in the 48 hours following the user's reimbursement request. Please note, however, that your payment may be slightly delayed according to your bank's clearance time.

9.4  The fees established for unconventional withdrawals such as Neteller, Click2Pay, or MoneyBookers, will be credited directly into the user account. These fees can be dependent on factors such as the currency used in the account or the user's place of residence.

10Exclusion of warranty

10.1   Poker770 offers a service and a software 'as is', with no warranties, insurance, commitments or any declaration. All implicit warranty is excluded from the present terms and conditions.

10.2  You acknowledge that Poker770 strives to provide a service and/or reliable software free of flaws (virii, bugs), but does not guarantee that the service and/or software will fully satisfy you and be exempt from errors.

10.3   It remains your responsibility to protect your system from all computer viruses and Poker770, under any circumstances, shall not be held responsible for the losses incurred. In case of viruses in our systems, we reserve the right to rescind the services in question without the obligation replacing them by a similar service.

11Modification of terms and conditions

11.1   Poker770 reserves the right to amend, modify and update the terms and conditions, game rules and privacy policy of this contract at any time.

11.2   It is your responsibility to inform yourself regarding the updated version of the terms and conditions published on our site, of the game rules and the privacy policy of this contract.

11.3  If you do not entirely agree with the terms and conditions of this contract, you shall immediately cease to use the software and uninstall it from your computer.   

12Disputes

12.1  You acknowledge and accept that all disputes between the user and Poker770 be solely based on the recordings made by Poker770. You also agree to the use of the Software RNG (RNG: Random Number Generator) which has the role of providing online poker games to the users and an adequate quantity of random numbers for all of our poker games.

12.2   You have acknowledged and accepted that any complaint or contest made by you made more than 7 days after the transaction in question will not be taken into account, and will have no value.

12.3   The original contract is formulated in English. If the contract is translated to another language, the English version shall prevail.

13Term and cancellation

13.1  You can cancel this contract at any time in writing to Chicoutimi Management Limited, Diagorou4, Kermia Building, Flat/Office 103, P.C. 1097, Nicosia, Cyprus, subsidiary of Mandarin Gaming NV, PO Box 4920, Curaçao, Dutch Antilles - under the condition that you have no outstanding amounts with Chicoutimi Management Limited and that your balance is not overdrawn.Chicoutimi Management Limited commits itself to reimburse any amount due.

13.2  The cancellation of this contract becomes effective only after you have received a notification in writing from our side confirming the cancellation.

13.3  From the moment when this contract becomes invalid, all existing obligations between the parties to this contract will be null and void, except if provided otherwise.

14Customer service

14.1  In order to optimize the quality of our services, your calls to our customer service can be recorded.

14.2   By accepting the present contract, you hereby allow us to use your personal information provided during your registration, to contact you directly, if deemed necessary, with the purpose of informing you about our services, offers, promotions and/or any other product that we may offer.

15Governing law / jurisdiction

15.1   This contract, its interpretation and its execution, as well as all other legal relations between the parties to this contract, should be regulated and interpreted according to the laws of England.

15.2   In case of complaint or dispute, the English version of this contract shall prevail against any other Poker770 version that we may have previously emitted. If you wish to be regularly in possession of the updated English version of our terms and conditions, please contact our customer service.

15.3   16.Any complaint or dispute, direct or indirect, arising from this contract shall be pursued in a Court of Law competent in England. In spite of the latter, Poker 770 reserves, at its discretion, the right to bring legal suit against any Poker770 service/software user in front of any competent court of law whether or not it be in the user's jurisdiction.

16Inactive Accounts

16.1   User account that has not logged into the Poker Room at least once for a consecutive 6 month will be considered as inactive account. At the discretion of the Poker Room, an inactive account may forfeit any Loyalty Points accrued. The Poker Room is not obliged to give any further justification for this action or notification to the player prior to the account being made inactive, although the Poker Room will attempt to give players 30 days notice. Unused Points expire after 36 months.

17Points770

17.1  The Points770 are attributed as part of the Poker770 loyalty programme.
17.2  The Points770 are collected by playing on the Poker770 real money tables, either tournaments, Sit & Go or cash game tables.
17.3  The Points770 can be used in promotions, Poker770 online store and to register to certain tournaments.
17.4  The Points770 shall remain valid provided that the Player’s account has been active during the last twelve month period. For the purpose of this Section, an “active” account means any Player’s account where the player has logged into and has played with the services at least once over the last twelve month period. Any Player whose Player's account has been inactive over the last twelve month period shall automatically forfeit all his Points770 and irrevocably authorize Poker770 to delete such points from his account.
